Living in Italy for a part of the year there dometimes tipping is sometimes make waiters uncomfotible. They have a decent livable salary!!

The main reason thus should be illegal is because servers are legally required to disclose their tip amount and pay taxes on their tips. This means that if they follow the law and claim their tips (if an order is paid by card, the tips are automatically claimed), they have to pay taxes on those tips, then the company goes and tries forcing servers to give some of their taxed income to fellow employees. These fellow employees generally are paid more and do not claim the money that servers are giving them. Thus means that servers not only lose some of the income that is supposed to be part of their full compensation, but then they also have to pay taxes on income that they aren't actually getting.
